This website, including its design, architecture, layout, appearance, navigation structure, source code, software components, databases, functionality, graphics, images, custom content, proprietary text, branding elements, and all related intellectual property (collectively, the “Website”), was independently conceived, developed, designed, and produced by Liquid UPC Corp. and shall remain the sole and exclusive property of Liquid UPC Corp.
Cross Creek II Patio Homes Association (“Association”) is granted a limited, non-exclusive, non-transferable license to use the Website solely for the management, communication, administration, and operation of the Association during the term of its service agreement with Liquid UPC Corp. No ownership interest, intellectual property rights, or other proprietary rights in the Website are conveyed, assigned, or transferred to the Association by virtue of such use.
Upon termination of services, expiration of any agreement, or discontinuation of the license granted herein, all rights to the Website, including its design, source code, structure, functionality, custom programming, databases, proprietary content, and related intellectual property, shall remain exclusively vested in Liquid UPC Corp. The Association shall have no right to copy, duplicate, transfer, migrate, reverse engineer, modify, reproduce, distribute, sublicense, or permit any third party to use or replicate any portion of the Website without the prior written consent of Liquid UPC Corp.
Notwithstanding the foregoing, ownership of the following materials shall remain with the Association or their respective owners:
Governing documents
Declarations, covenants, and restrictions
Bylaws
Rules and regulations
Architectural Review Committee (ARC) guidelines, forms, applications, and booklets
Meeting minutes
Financial statements and reports
Legal notices and correspondence
Official Association records
Documents, photographs, logos, and content supplied directly by the Association
The Association retains ownership of its data and official records submitted to or maintained on the Website; however, the Website platform, software, design, organization, presentation, and all proprietary elements used to display, manage, or deliver such information remain the exclusive property of Liquid UPC Corp.
Any unauthorized reproduction, copying, extraction, modification, adaptation, distribution, publication, transfer, or creation of derivative works based upon any portion of the Website owned by Liquid UPC Corp. is strictly prohibited and may result in legal action to the fullest extent permitted by applicable law.
All rights not expressly granted herein are reserved by Liquid UPC Corp.
